Medico-Legal Psychological Assessment

Psychological Assessment plays a key role in medico-legal settings by providing independent, evidence-based examination and expert opinion regarding psychological illness and the psychological consequences of injury. Their primary function is to assist courts, tribunals, insurers, and legal professionals in clarifying the presence, nature, severity, and functional impact of psychological conditions in a legally relevant context.

In cases involving illness or injury, a comprehensive psychological assessment is conducted that may include clinical interviews, standardised psychometric testing, review of medical and collateral records, and consideration of pre-existing vulnerabilities and psychosocial factors. The assessment focuses on diagnosis (where appropriate), symptom validity, consistency of presentation, and the relationship between the alleged incident and the psychological condition, including issues of causation, exacerbation, or contribution.

A formal medico-legal report is then prepared that clearly explains findings in accessible, non-technical language while adhering to professional and legal standards. Reports typically address questions such as the impact of illness or injury on cognitive, emotional, and behavioural functioning; capacity for work or daily activities; prognosis; treatment needs; and the degree of impairment. Importantly, this form or assessment maintains objectivity and independence, acting as an expert to the court rather than an advocate for any party.

Overall, my role as a clinical psychologist in conducting an assessment for this purpose is to translate psychological evidence into reliable, impartial opinion that support fair and informed legal decision-making in matters involving illness, injury, and their psychological consequences.
